1. Am I affected by this? The Live Entertainment Contractor Licensing Regime changed on October 1, 2019.
These developments concern you if you have a live entertainment activity, that is an activity of producer, broadcaster or tour contractor, operator of venue.
This new legal regime:
- relax the conditions of competence or experience;
- set up a teleservice for reporting;
- allows the administration to object to the declaration within one month;
- puts in place a more operational a posteriori control.
The objectives of the regulations:
- to protect the artist and other employees from the performing arts by ensuring respect for labour law and their social rights;
- ensure compliance with the rules on authors' remuneration;
- ensuring the sustainable development of the performing arts sector;
- create conditions conducive to artistic creation.
2. Where can I declare my activity in view of a receipt which, unless opposed by the administration, will be considered a licence?
My main activity is the live show, OR, it is not the live show but more than six shows per year are given: an online approach is mandatory via this link for a first declaration or via this link for a renewal.
After account creation (or identification if the registrant already has an account), the form must be filled out directly online.
Supporting documents to download will be requested throughout the steps of the form. To make it easier for you to complete the form, see table of documents and information that will be asked of you.
Upon validation of your form, your return will be forwarded to the Regional Cultural Affairs Directorate (RDCA) on which your organization’s principal place of business depends. If you are not established in France, the information is sent to the DRAC of the first representation.
Upon validation of your electronic declaration, you will receive a receipt at the email address provided during the creation of your account.
If:
- the declarant meets the conditions laid down by law (in particular in terms of the training, experience or competence of the contractor, and respect for labour law, social law, intellectual property law and the safety of performing arts venues),
- and that the administration did not object to it after verifying compliance with these conditions,
then the receipt of the declaration will be deemed to be a licence after a period of 30 days after receipt by the Drac of a complete and legal file.

3. License Reform in Brief
The essence of the reform
As of October 1, 2019, the legal regime for carrying out the activity of a live entertainment entrepreneur is subject to the obligation to report the activity online for entrepreneurs established in France, and the obligation of online information for entrepreneurs established outside France.
The objectives of the procedure are identical to those of the licence for performing arts contractors in force before 1 October: verification of compliance with social law, labour law, intellectual property law and the safety of performing arts venues.
The procedures are now completely paperless (no sending of paper files; there is no longer a downloadable «cerfa» document).
The activity of live entertainment contractor subject to a prior declaration, which may be refused or invalidated by the prefect – via the services of the regional cultural affairs departments.
If the prefect does not object to the declaration, the receipt then valid allows to exercise one month after receipt by the administration of a complete file and in accordance with the law.
Any body (private, public, mixed) or any natural person (private employer, business natural person) whose main activity is the show is bound to this procedure.
Similarly, bodies or natural persons who carry out this activity for more than six performances a year, and amateur groups who call upon performers paid for more than six performances a year, are bound by the procedure.
The declarations of occasional shows are deleted. The regulations concerning the obligation to resort to the GUSO are also unchanged. www.guso.fr

Training and skills inventories
The acquisition of a licence as a performance contractor is subject to conditions such as diplomas, experience, training or skills (see form 4.1).
Concerning training and skills, for all show entrepreneurs The National Joint Employment Commission Live Performance Training (CPNEV-SV) has created a directory of recognised training and skills for licensure.
Concerning the additional mandatory training for venue operators CPNEF-SV has created a second directory (obtaining a receipt for category 1 licences).

Live entertainment contractor licensing regulations effective October 1, 2019:
6. What is the procedure for a show organization not established in France that wants to organize a tour in France?
In order to carry out the activity of entrepreneur of live shows in France, it is mandatory to inform the regional direction of cultural affairs of the region of the show (or the region where the first performance takes place, if there is a series of performances) at least one month before the first performance.

Time limits for applications to administrations To whom does Order No. 2020-306 of 25 March 2020 on the extension of time limits for the health emergency period and the adaptation of procedures during the same period apply? The ordinance shall apply to State administrations, local and regional authorities, their public administrative establishments and to bodies and persons governed by public and private law entrusted with a public administrative service mission, including social security bodies. What amendments does Order No. 2020-306 of 25 March 2020 make to the time limits for instructions of applications to the administration? Any application submitted to the authorities listed above shall, in principle, run for a period at the end of which the service seized shall be deemed to give a decision, agreement or opinion, whether implied or explicit. The order suspends the remaining time limits that are due to expire between March 12, 2020 and June 23, 2020. This suspension also covers periods that should have begun to run during the same period: these periods will not begin to run until 24 June 2020. What procedures are concerned? The suspension shall apply to all periods during which a decision, agreement or opinion of one of the authorities listed above is likely to take place. Decision-making systems for which the silence of the administration constitutes acceptance, and in particular the procedures for declaring the activity of a live entertainment contractor, whether for a first declaration or a renewal. The latter regime provides for tacit acceptance after 30 days, unless the administration objects, the time limits for processing files run until 24 July for all files filed from 11 February 2020. |
