Carry out work near a historic monument
Perimeter protection applies to buildings that form a coherent whole with a historic monument or that contribute to its conservation or development. Boundary protection is a public easement whose purpose is the protection, conservation and enhancement of cultural heritage. Carrying out work in the vicinity of historic monuments therefore requires prior authorization.
Works likely to modify the exterior aspect of a building, built or not built (courtyard or garden for example), protected under the surrounding are subject to prior authorization requiring the agreement of the architect of the buildings of France.
Currently, more than half of the 400,000 opinions issued annually by the architects of Les Bâtiments de France (ABF) concern the surroundings of historic monuments.
Within the boundaries of the approaches, all work on buildings protected under the approaches is subject to the agreement of theABF.
In the absence of a delimited perimeter, sworks on buildings located within the visibility of a historic monument within 500 metres of it are subject to the agreement of theABF.
The AFB shall ensure that the work does not adversely affect the historic monument or the surroundings of the historic monument. It also ensures respect for the public interest attached to heritage, architecture, the natural or urban landscape, the quality of the constructions and their harmonious insertion in the surrounding environment.
Thes work in the vicinity ofs historical monuments and in remarkable heritage sites (link to section "Carrying out work in a remarkable heritage site") fall under the same regime work authorization.
The procedures and deadlines for the appraisal of work authorizations have been harmonised by Law No. 2016-925 of 7 July 2016 on freedom of creation, architecture and heritage.
Any request for work authorization must be filed with the town hall of the municipality where the work is planned. The time limits for processing work authorization applications are:
- two months for prior declarations;
- three months for demolition permits and building permits for a detached house;
- four months for other building permits and development permits.
The period available to the AFB for approval is one month for prior declarations and two months for all permits.
The AFB Agreement may include requirements to ensure that the Project does not adversely affect the conservation or enhancement of the historic monument or surrounding area.
If the AFB does not agree, the work authorization request cannot be granted. An appeal against the refusal of the AFB may be exercised by the applicants or the competent authority responsible for issuing the work authorization (common or inter-communal generally).
If the architect of the buildings of France participates in the instruction of the applications of authorization of works, it also plays a leading role upstream of the realization of the projects.
As such, it can be consulted on a draft and provide comments that will allow applicants to adapt their project to heritage issues.
