Film exploitation
Cinema activity is governed by the Film Code
The Cinema code, is divided into five chapters:
- administrative organisation;
- professions and activities;
- financing and taxation of film and other visual arts and industries;
- controls and sanctions;
- certain provisions relating to the overseas territories.
The classification "Art et Essai"
The "Art et Essai" classification aims to support cinemas that exhibit a significant proportion of recommended films "Art et Essai" and that support these often difficult films with an adapted animation policy.
Any holding holding the authorization to practise the profession may apply for classification (the room must pay the special fee regularly). The ranking is based on an automatic index indicating the proportion of sessions made with recommended "Art et Essai" films compared to the total sessions offered.
The ranking is decided by the President of the National Centre for Cinematography and Animated Images (CNC), after the opinion of the National Film Commission of "Art et Essai" which examines the application files for classification of establishments.
The Commission’s opinions are based on the recommendations of the regional working groups, in which the DRAC Cinema and Multimedia Advisors sit.
Three labels can be awarded to theaters according to their specificity: label "Research and Discovery", "Young Audience" or "Repertoire and Heritage".
In the Grand Est region, 67 establishments were classified as "Art et Essai" in 2018 (122 cinemas registered in 2015).

Build equipment with more than 300 seats or add to existing equipment. | Your project must be approved by the Departmental Commission for Commercial Development in Cinematography | CDAC. Take the attachment of the secretariat of the CDAC to the Prefecture of the implementation department which will tell you the steps to follow and the documents to provide to deposit your file. The Commission decides on the following two criteria: The potential effect on the cinematographic diversity offered to viewers in the relevant area of cinematographic influence, as assessed by the following indicators: - the proposed programming project for the establishment of cinematographic shows which are the subject of the application for authorization and, where appropriate, compliance with any programming commitments made, - the nature and cultural diversity of the cinematographic offer offered in the area concerned, taking into account the number of cinema visitors, - The situation of access of cinematographic works to cinemas and cinemas to cinematographic works for existing cinematographic establishments. The effect of the project on cultural land use planning, environmental protection and the quality of urban planning, assessed using the following indicators: - the geographical location of cinematographic establishments in the zone of cinematographic influence and the quality of their equipment, - the preservation of cultural activity and respect for the balance of urban areas, - The environmental quality assessed by taking into account the different modes of public transport, the quality of the road service, parking lots, - the integration of the project into its environment, - The location of the project. |
Apply for authorization to operate and certify film equipment. | - Go to the section "Authorisation of exercise and approval of rooms" of the CNC site, - Download, complete and return authorization and approval forms. |
Request the transfer of tickets from your licensed room to another location on a temporary basis. (Due to work for example) | - Go to the section "Authorisation of exercise and approval of rooms" of the CNC site, - Download, complete and return the DEF specified or undetermined displacement declaration forms. |
Expand your circuit. | The request should be directed to the NCC who will forward it to the RDCA you are reporting to for review. |
Do an outdoor movie. | Any screening must be authorized by the CNC, whether for free or for a fee, for any screening of films longer than 59 minutes. The deadline for the broadcast of feature films is one year from the date of the visa ("Visa and classification" on the NCC website). No deviation from the deadline can be issued. The specific authorisation shall be issued taking into account the following criteria: - the place and number of meetings envisaged, - the social and cultural value of the projections, - the local situation of film exploitation. You must apply through thecomputer interface. Drac will review your request and advise the NCC who will respond. |
Create a movie club or organize a few sessions in the year in an exceptional way. | Non-commercial film sessions may be organized, exceptionally, in compliance with the rules, by structures and places that do not have an authorisation to exercise the CNC (associations, libraries and media centres, schools, museums and cultural institutions, socio-cultural centres, etc.). It is advisable to approach the CNC or DRAC upstream. Go to the section Non-commercial broadcasting from the NCC website. |
Submit an application for financial assistance to the CNC for the construction or development of a cinematographic equipment in insufficiently equipped areas (selective aid for the modernization or creation of cinemas). | Check the status of your automatic support (if you have one) with the NCC and complete the downloadable documents. |
