National Fund for Sustainable Employment in Entertainment (FONPEPS)
The National Fund for Sustainable Employment in Entertainment (FONPEPS) is the first fund created to support sustainable employment in entertainment.
What is the FONPEPS?
This is the first fund created in 2016 to actively support sustainable employment in live and recorded performance, in both the public and private sectors. The fund is intended for public companies and performing arts establishments as well as the artists and technicians they employ, encouraging job creation and encouraging structures to extend the duration of employment contracts.
Why create this Fund?
The FONPEPS is the culmination of a work initiated during the conference for employment in the show of October 2015. It continued with a consultation phase, led by the Ministry of Culture, between the social partners representing employees and companies, in conjunction with the ministries in charge of Labour and the Budget.
This fund reflects the Government’s desire to promote sustainable employment in the entertainment sector, in particular by supporting the hiring of permanent contracts. The fund is allocated by the State to meet eligible applications until 31 December 2022.
What are the measures of FONPEPS?
The different FONPEPS measures are presented in detail in the tabs below. Links to the application forms, the relevant regulatory texts or the relevant websites are provided for each measure.
New aid managed by the ASP
- Aid shall be paid subject to compliance with the maximum threshold of 200,000 euros of public subsidies collected over 3 fiscal years (Regulation (EU) No. 1407/2013) of the European Commission of 18 December 2013).
- Aid may not be combined with other State aid for integration, access or return to employment paid by the employer in respect of the same employee.

Since 1er October 2019, this one-time assistance for hiring on an indeterminate (CDI) or fixed-term (CDD) contract replaces the first four FONPEPS measures:
- assistance in hiring the first employee (APS),
- the permanent employment premium for show employees (PEPSS),
- support for the hiring of young graduate artists (AJAD),
- and the long-term contract premium (LTCP).
The examination of files and the payment of financial aid are provided by the Service and Payment Agency (ASP).
This new unique aid also provides more specific support for the employment of permanent choir opera artists and voice artists in residence in schools.
Attention
For contracts that started before 1 October 2019, the first four aids under the old scheme continue to apply until 31 March 2020 at the latest.

At least one of the following conditions must be met by the applicant:
- be subject to a collective agreement referred to in Article 71 of Annex VIII to the unemployment insurance regulations annexed to decree no. 2019-797 of 26 July 2019 ;
- belong to the list of public enterprises and establishments covered by the unemployment insurance regulation (Article 71 of Annex VIII annexed to Decree No. 2019-797 of 26 July 2019);
- be the holder of a performance contractor’s licence and be affiliated with the Caisse des congés du spectacle.
For specific help dedicated to the recruitment of a permanent choir lyric artist or voice artist in residence in schools, the applicant must belong to the list of structures in the order of 25 November 2019 of the Minister of Culture.
Main conditions to be met concerning the employee:
- the hiring of an employee must be carried out under a permanent contract (CDI) or a fixed-term contract (CDD);
- the functions performed must fall under Annexes VIII and X of the unemployment insurance regulation annexed to Decree No. 2019-797 of 26 July 2019;
- the start of execution of the contract must be set between 1 October 2019 and 31 December 2022.
For the specific help dedicated to the recruitment in CDI of a lyrical artist of permanent choir, The latter must replace another permanent choir artist whose functions are modified within the same structure.
For the specific help dedicated to the recruitment of a voice artist in residence in school, the contract must be concluded for a minimum period of 6 months and must have as its object the conception and the realization of an artistic project of collective vocal practice.
What are the amounts of aid depending on the type, duration and working time of the contract?
- Hiring a permanent employee: up to 10,000 euros per year for 3 years;
- hiring an employee on a fixed-term contract: from 200 to 500 euros per month depending on the duration of the contract (minimum 1 month);
- Permanent hiring of a permanent choir lyric artist to replace a permanent choir lyric artist changing functions in the same structure: up to 16,000 euros per year for 3 years;
- Fixed-term employment of at least 6 months for an artist of the voice: lump sum of 9,000 euros.
Attention
The amount of aid is prorated according to the duration of the employee’s work if it is less than one full-time job (except for a fixed-term contract of 1 month or more and less than 2 months for which the duration of work is compulsory full-time to benefit from the aid), and the total duration of the contract.

Managed by the Agence de services et de paiement (ASP), this aid is intended for producers of live performances directly using the artistic stage for performances produced in small-scale theatres (maximum 299 seats).
Eligible representations are between July 6, 2018 and December 31, 2022.
Conditions to be met by the applicant:
To benefit from the aid, companies or associations must meet all the following conditions:
- have been created for at least 12 months on the date of the representation for which the aid is requested;
- present an annual turnover or balance sheet not exceeding one million euros;
- be covered by a national collective agreement for performing arts referred to in Schedules VIII and X of the General Regulation annexed to the Agreement on Unemployment Insurance of 14 April 2017
- be licensed as an entertainment contractor;
- pay to each employee making up the artistic platform a remuneration at least equal to:
- in case of remuneration: 109.50 euros gross (amount valid for the year 2020)
- in case of monthly remuneration: 2,299.50 euros gross (amount valid for the year 2020)
- justify that the size of the place of performance is less than 300 seats (maximum 299) by submitting the minutes of the security commission with the application form, or a declaration on the honour of the mayor for a room directly under his responsibility, or a photo of the safety data sheet displayed in the performance hall with the information on the gauge and the identification of the hall.
What are the amounts of aid?
For each performance, the amount of aid paid is calculated according to the number of performers in the show (maximum six) multiplied by the following lump sum:
- for the employment of one or two artists: 38.33 euros
- for the employment of three artists: 49.28 euros
- for the employment of four artists: 60.23 euros
- for the employment of five artists: 71.18 euros
- for the employment of six artists: 82.13 euros
Where at least one technician is attached to the production of the representation, the number of jobs taken into account for the calculation of the aid shall be increased by one unit.
Example: for an artistic board composed of 3 artists and a technician, the aid for a representation is equal to: 3 x 49.28 + 1 x 49.28 = 197.12 euros.
Additional information
- The same undertaking or association may benefit from the aid within the limit of A maximum of 42 performances per calendar year.
- The company or association requesting assistance must address its request to the ASP in a maximum period of six months following the date of the representation for which the aid is sought.
- Companies whose the main activity falls under the national hotel collective agreement cafés restaurants are excluded from this measure.

Managed by the Service and Payment Agency (ASP), this scheme aims to promote the direct employment of artists for recording sessions for the production of a phonographic recording (album). Aid shall be paid a posteriori on the basis of the amount of the gross basic fee plus employer contributions, on presentation of supporting documents, according to a principle of progressivity ranging from 25% to 60% depending on the number of artists participating in the phonographic recording.
This measure is funded jointly by the Ministry of Culture and professionals in the phonographic publishing sector.
Conditions to be met by the applicant:
To benefit from the aid, the eligible labels (companies or associations) must complete the whole of the following conditions:
- have fewer than 10 employees calculated as full-time annual equivalents;
- have been created for at least one year from the date of sending the request for assistance;
- be subject to corporate tax;
- have an annual turnover or balance sheet that does not exceed two million euros;
- pay to performers participating in the making of the phonographic recording a stamp at least equal to the amount the basic gross stamp fixed for a three-hour service (Title III of Annex III of the National Collective Agreement for Phonographic Publishing).
Additional information:
The company or association requesting assistance must address its request to the ASP in a maximum period of six months following the end date of the phonographic recording for which the aid is sought.

This aid for companies in the performing arts is conditional on the hiring of a first employee on permanent contract (CDI) whose salary is less than 3 SMIC. It is paid at the rate of 1,000 euros per quarter (4,000 euros per year) for two years.
If the employee is hired part-time, the aid is prorated according to his work volume. If the contract is broken, the aid is paid in proportion to the period worked.
This scheme encourages the creation of a permanent job to help professionalize the structure and its development.

The Premium for the permanent employment of show employees (PEPSS) is paid to show companies for all permanent contract (CDI) of a an employee who has received, in the last 24 months preceding the signing of the contract, benefits paid under Annexes VIII or X of the General Regulation annexed to the Unemployment Benefit Agreement. The employee’s salary must be less than three SMIC.
The amount of aid is decreasing over four years: 10,000 euros in the first year, 8,000 euros in the second, 6,000 euros in the third and 4,000 euros in the last. If the employee is hired part-time, the aid is prorated according to his work volume. If the contract is broken, the aid is paid in proportion to the period worked.
This aid aims to promote employment on permanent contracts to combat the precariousness of show workers.

The bonus for long-term contracts in the entertainment sector is an aid to the hiring of employees, artists or technicians, in fixed-term contract (CDD) of long duration, whose salary is less than three SMIC, in the companies of the show of less than 100 full-time equivalent employees per year. The employee must, before being hired, have received, in the last 24 months preceding the signing of the contract, allowances paid under Annexes VIII or X the General Regulation annexed to the Unemployment Benefit Convention.
The aid, which is renewable, is paid at the rate of 500 euros for any contract lasting two to three months, 800 euros for any contract lasting three to six months, 1,800 euros for any contract lasting six months to twelve months and 4,000 euros for any contract lasting one year or more.
This system encourages long-term employment rather than contract splitting.

In the amount of 1,000 euros per month, this assistance is paid for four months for any hiring of an artist in permanent contract (CDI) or in fixed-term contract (CDD) of a at least four months, within three years of graduation artistic.
For the same employee, the aid is renewable every twelve months following the date of commencement of the contract, within three years following the issue of the diploma.
This system must allow young artists with a diploma training in the professions of performing artists, the list of which is set by an order of 19 January 2017, to find and confirm a first professional experience.

Managed by the social protection group AUDIENS, this scheme aims to support the return to work of artists and technicians young parents, helping them to finance the care of their child(s). He plans to pay this assistance until the child’s 4 years, in the form of a reimbursement of childcare expenses, on presentation of supporting documents.
The financial assistance is determined according to the number of eligible hours varying according to the number of hours of home care necessary for the performance of the employment contracts of the artist or the technician (ne). The support allows a coverage of up to 50% of the childcare costs (at home, in nursery, with a maternal assistant, etc.) carried out in accordance with the rules in force for each guard.
This assistance is exclusive and cannot be combined with other childcare assistance for the same benefit, with the exception of any tax credits. The maximum annual amount of aid is up to 3,000 euro. If both parents are eligible, only one aid per household is allocated for the same benefit.

Throughout the national territory, many cafes and restaurants host cultural and artistic practices, offering a space for dissemination and meeting with the public. The public interest group (GIP) «Cafés-Cultures» supports this pool of artistic jobs in compliance with social regulations and diversity of practices, while contributing to the economic dynamism and attractiveness of the territories.
The GIP Cafés Cultures manages the aid fund to promote artistic employment and the creation of live performances in cafés and restaurants. This system supports, on justification of an employment contract with the artist via the Single Window Occasional Show ( GUSO: www.guso.fr ), part of the salary, including social security contributions, of the artists and technicians of the show.
This tool is a real support for employers who want to organize occasional shows in their institutions.
The benefit cafés and restaurants are obligatory employers of artists and technicians (ne)s. All employees must be declared to GUSO and their remuneration must respect a minimum amount indicated by the National Private Performing Arts Collective Agreement.
Recipients must meet the following criteria:
- fall under the National Collective Agreement for Hotels, Cafes and Restaurants (UNHCR) ;
- hold a liquor or restaurant licence;
- be a Class 5 Type N Public Receiving Establishment (PRA) (less than 200 seats);
- from 7 performances per year, be holders of the licence of show entrepreneurs.
