As part of her priority to combat commercial piracy, the Minister of Culture and Communication entrusted Mireille Imbert-Quaretta, the mission to think about ways to effectively combat commercial piracy of cultural works on the internet.
Monday, May 12, Mireille Imbert-Quaretta presented to the Minister the conclusions of her report.
The improvement and strengthening of tools to combat sites hosting massively pirated works and content, by involving intermediaries such as those involved in advertising or online payment (so-called “Follow the money” approach), was one of the avenues proposed, in particular, by Pierre Lescure’s report for Act II of the cultural exception. The purpose of the report entrusted to Imbert-Quaretta by the Minister of Culture and Communication was to take the next step by developing operational tools.
This report, underpinned by a pragmatic approach, proposes the implementation of three types of tools:
- Encouraging those involved in online advertising and payment to sign and respect charters specifying their framework for involvement and intervention in the fight against copyright infringement on the Internet; these types of charters already exist, particularly in the United Kingdom;United States, where agreements have been concluded between rights holders and sectoral actors to define best practices;
- this self-regulatory approach would be complemented by systematic information on websites massively infringing copyright: a public authority would thus be responsible, on the basis of verified information on copyright infringements, to draw up the list of sites concerned; this list would then serve as a reference to secure self-regulatory actions and inform all technical and financial intermediaries at the sites in question;
- finally, the report makes a number of proposals to combat the reappearance of pirated content that has been deleted, and to avoid circumvention of court decisions concerning sites containing massive amounts of counterfeiting. In particular, an extended withdrawal injunction could be created and the burden of its delivery entrusted to a public authority.
All the proposals will be examined in order to enrich the guidelines of the Ministry of Culture and Communication in terms of copyright protection and the fight against commercial piracy.
