The preparatory work carried out by Hadopi in recent months should be commended, particularly the technical cooperation links established with Internet service providers.
The Ministry had informed operators in September that, as soon as the graduated response was launched, their requests for compensation for the additional costs represented by the identification of subscribers from IP addresses would be taken into account, on the basis of an estimate incorporating the automatability of the process. This commitment will be kept. It will provide a sustainable financial framework for cooperation between Hadopi and operators.
The reversal of Free, which decided on Monday not to transmit warning messages to its subscribers at this stage, in formal violation of its legal obligations, is unacceptable. This situation, which the minister strongly condemns, must end as soon as possible.
The laws «Creation and Internet», which have provided the necessary framework for the long-term development of a abundant and quality legal offer, will be applied. An access provider who does not comply with its legal obligations will therefore have to bear the legal and financial consequences. A decree will shortly specify the sanctions provided for in this framework.
