Following the symposium held in March 2018 on Public law and property ”, the History Committees of the Ministry of Culture and the Council of State and Administrative Jurisdiction wished to continue the study of the role of the Council of State, both as a judge and as an advisor to the government, in the public policies of culture.
This second part will first study the genesis of the notion of cultural public service, its legal forms and its dynamism. The conference will focus on the jurisprudence of the Council of State on live performance, and in particular theatre, by which the administrative judge recognized the existence of a cultural public service, defined its own criterion (quality) and adapted the public service regime to the specificities of the cultural sector.
Secondly, it will measure the operational character of the cultural public service, through the question of its appropriation and implementation by actors, political and cultural leaders, artists and creators. We will question the plasticity of the notion of cultural public service. The missions of the cultural public service, its management and legal translation, will be examined through the prism of the contemporary issues it faces, from the question of cultural rights to its adequacy to current artistic projects.
Organized in partnership with the Comédie-Française and the Institute of Social Sciences of Politics, the symposium will take place over three half-days, the Friday 26 and Saturday 27 November, and alternate scientific communications and roundtables with industry stakeholders. It will be accompanied by an exhibition illustrating the major stops of the cultural public service.
