Sheet 2.1. Category 1: operator of a live performance venue for public performances
Definition: The place of live performances is arranged with a space of representation, a space for the public, a space for the artists (lodges or similar). The concept of development is understood by the specific development of this place (example: stage, bleachers, lighting ramps, etc).
For places where this development is temporary during the year, we will consider that beyond six performances, it is a place of live performances. Attention, even within seven representations, a base of safety rules must be respected - These are the common law requirements of establishments receiving from the public – but there are no specific steps to be taken with regard to the regulation of entertainment entrepreneurs.
Examples:
- I am a tenant of a hall, which I maintain, which I have set up for public performances: I am an operator of a place of live performances. If the owner is responsible for the development and maintenance of a venue for performances, he is the operator of a live performance venue;
- I’m organizing a street show. The town hall allowed me to occupy the village square for some performances but I am responsible for the bleachers, the boxes, the stage, even the lighting. I am then operator of a place of live performances (outdoor place specifically arranged);
- I transformed a barge or a bus into a concert hall: I am the operator of a concert venue;
- I am responsible for a place of worship where ceremonies take place: the works of the spirit interpreted for the liturgies are an integral part of the worship, which is not a living spectacle. If the place of worship organizes a show outside the cult and a specific arrangement is put in place for these purposes, it is a live show: for example for a festival of Gregorian music in a chapel for a week, a series of gospels with ticketing, a Mozart requiem or a variety concert given in a cathedral. Note that even when it is free, a ticket office must be set up (in case of accident, ticket stubs will give the indication of the number of people to evacuate);
- I organize a festival of living arts (dance, music, theatre, circus, street arts, etc.): I am a show entrepreneur.

The obligation to declare the operation of a performance venue falls on the person who actually operates a performance venue specially designed for public performances, who has a title of occupation (property, lease, management contract, provision), which is responsible for its layout and maintenance.
The representation of a show in the venue set up for these purposes requires, in addition to that of the operator, the presence of a producer and, where appropriate, a broadcaster (see definition in the corresponding practice sheets). If the operator himself performs these functions he must have made the corresponding declarations. If the production and broadcasting responsibilities are carried out by other persons holding the corresponding licences, producer, broadcaster or tour contractor, the operator of the premises shall only be required to hold the 1st category licence.
The concept of “arranged” venues includes both traditional venues - including circuses - and multi-purpose venues and spaces that are temporarily set up as venues, such as sports arenas or places of worship.
Only when these venues host performances with paid professionals more than six times a year must they hold a valid licence.
The obligation of licence does not apply to those responsible for places in which only fully amateur shows or events are organized that do not meet the definition of performances of shows in Article L. 7122-1 of the Labour Code.
