Energy savings in buildings of heritage interest for tertiary use
The objectives of reducing the final energy consumption in parts of existing buildings or assemblies of buildings for tertiary use may be modulated in the presence of technical, heritage or architectural constraints relating to the buildings concerned.
Ambitious targets to reduce final energy consumption in the tertiary sector
The article L. 174-1 of the Building and Housing Code provides that actions to reduce the final energy consumption are implemented in buildings, parts of buildings or assemblies of existing buildings for tertiary use, defined by decree of the Council of State, in order to achieve a reduction of final energy consumption for all buildings subject to the obligation toat least 40% in 2030, 50% in 2040 and 60% in 2050, compared to 2010.
A possibility to modulate these objectives in the presence of technical, architectural or heritage constraints relating to the buildings concerned
The article R. 174-26 of the Building and Housing Code specifies that the modulation of the targets for the reduction of final energy consumption can be implemented when certain actions likely to contribute to the achievement of the objective entail in particular significant changes in the condition of the exterior parts or of the architectural and decorative elements of the construction, in contradiction with the rules and regulations laid down for listed or inscribed historical monuments, the remarkable heritage sites or the surroundings of the historical monuments mentioned in Book VI of the Heritage Code, or "the buildings, buildings or architectural ensemble having received the label mentioned in the article" L. 650-1 of the Heritage Code ».
Conditions for modulating the targets for reducing final energy consumption
The order of the 10 April 2020 on equity bonds to reduce final energy consumption in tertiary buildings Chapter II sets out the conditions for modulating the targets for reducing final energy consumption.
The technical file
Article 7 specifies the content of the technical dossier drawn up to justify the modulation of the objectives of reducing final energy consumption.
- An energy study on actions to improve the energy and environmental performance of buildings resulting in a reduction in final energy consumption and corresponding greenhouse gas emissions.
- An energy study on actions to reduce the consumption of equipment related to specific uses.
- Identification of actions concerning the adaptation of premises to energy-efficient use and the behaviour of occupants.
- A program of actions to achieve the objective, which is based on all the levers of actions referred to in II of article R. 131-39 of the code of construction and housing.
The technical file is supplemented, depending on the nature of the modulations to which it is subject, by:
- a specific technical note justifying the modulation of the objectives according to technical constraints, referred to in Article 9 III of the aforementioned Order;
- the detailed opinion justifying the modulation of the objectives according to architectural or heritage constraints, referred to in IV of Article 9 of the same decree;
- the gross return on investment calculation note of the building energy performance improvement action programme, justifying the modulation of the objectives in case of manifest disproportion of the cost of the actions in relation to the expected benefits in terms of final energy consumption, referred to in Article 11 of that decree.
The file can be updated to update the rationale for the target modulations.
The decree specifies that the main supporting elements of modulation of objectives or failure to achieve objectives are summarised in a standardised table in CSV format.
The action programme
The action programme presented in the technical dossier must focus on:
- summarize for each of the action levers mentioned in II of Article R. 131-39 of the Building and Housing Code, the actions that have already been carried out and those that are scheduled with an indication of their estimated completion date;
- quantify the energy and greenhouse gas emission gains already achieved from the actions already carried out and assess the expected gains from actions still to be implemented;
- identify for each planned action whether it is the responsibility of the owner and/or lessee.
The modulation of objectives
The modulation of objectives under Article R. 131-40 of the Code de la construction et de l'habitation can only be taken into consideration if the action programme demonstrates that all the action levers mentioned in II of Article R. 131-39 of the Building and Housing Code have been mobilized or will be mobilized.
The Ministry of Ecological Transition and theADEME make available a Energy Performance, Renovation and Tertiary Actions Observatory (OPERAT). This platform for collecting and monitoring energy consumption in the tertiary sector is a tool to support tertiary stakeholders in the energy transition.
