Regional Heritage and Architecture Commissions
Established by the Law of 7 July 2016 on freedom of creation, architecture and heritage, the Regional Heritage and Architecture Commissions (CRPA) are consulted on creation, management and monitoring of easements of public utility and planning documents established for the protection, conservation and enhancement of cultural heritage. The CRPA replaces the former regional commissions of heritage and sites (CRPS), placed with the prefects of region, and the former departmental commissions of movable objects (CDOM), placed with the prefects of department. Placed with regional prefects, the RCAP is chaired by an elected official.
Organization and Composition of Regional Heritage and Architecture Commissions (RCAP)
Each RCAP is organized into three sections:
- Section 1 “Protection and enhancement of architecture and real estate assets”
- Section 2 “Architectural Projects and Building Works”
- Section 3 «Protection of movable objects and works»
Each section is composed of 27 members divided into four colleges:
- representatives of the State;
- holders of elected office;
- representatives of associations or foundations whose purpose is to promote knowledge, protection, conservation and presentation of heritage;
- qualified personalities.
Each section shall have a permanent delegation of 10 members who may either give an unfavourable opinion on behalf of the committee on the dossier submitted to it or decide whether to refer it to the section concerned, which shall meet in plenary session.
RCAP also includes a Section Committee that considers matters other than those within the jurisdiction of the Divisions.
RCAP members are appointed by decree of the prefect of the region for a period of five years, with the exception of ex officio members.
The Chairman of the Regional Commission heritage and architecture is chosen by the regional prefect from among the members holding an elective mandate.
RCAP Awards
The first section CRPA is responsible for the protection of buildings under the title of historic monuments, architectural and heritage development plans, the awarding of labels, the delimited perimeter of the surroundings and planning documents.
The second section is responsible for architectural projects, studies and works on buildings, in the event of disagreement between the competent authority for planning authorisations and the architect of the Buildings of France (appeal against the opinions of the ABFs) and in the event of a derogation from the planning document for projects whose implementation is of public interest in terms of quality and architectural innovation or creation.
The third section is responsible for the protection of movable objects under historical monuments, preventive conservation, studies and related works.
RCAP can propose any action to ensure the protection, conservation and presentation of heritage and architecture. It may also be consulted on studies and work and on any question relating to heritage and architecture pursuant to Book VI of the Heritage Code and the Subsection 2 of Section 4 of Chapter Ier of Title V of Book Ier of the Urban Planning Code (provisions of PLU’s urban, architectural, environmental and landscape quality regulations).
