Opening up public data
To meet its commitments to open public data, the ministry offers the following guides and tools:
“Opening Cultural Public Data – Practical Guide” (July 2019).
This guide describes the main issues and the legal framework of this public policy and proposes an approach and a set of resources (departmental doctrine, use cases, tools, etc.) : Specific regulatory or technical aspects can be specified by means of fact sheets and annexes. This guide is mainly intended for the departments of the Ministry (central, decentralised, with national competence) and public institutions under its supervision.
“Dissemination of cultural content: what rights, what steps?” (January 2020).
This educational tool is intended to facilitate the understanding of literary and artistic property rights applicable to the cultural contents whose dissemination is desired.
The Ministry of Culture provides cultural actors and citizens with a educational tool, intended to facilitate the understanding of literary and artistic property rights applicable to the cultural contents whose dissemination is desired. It is intended to inform the holder of content such as a book, photograph or musical recording of the questions to be asked in order to know whether the content concerned is protected by copyright or a related right or whether other rights are intended to apply. The decision tree aims to make the law more accessible by modelling a sometimes complex legal reasoning. It cannot provide a definitive answer to certain situations for which there would be a lack of information necessary to identify the status of the work. This decision tree is intended to be completed and improved based on user feedback.

This work is independent of exceptions to copyright and related rights that may otherwise apply for certain uses, such as the private copying exception or the short-citation exception. For more information on this point, please refer to datasheets published at this address.

This report has four objectives: to explain in the most concrete way possible the scope of the cultural open data movement, to clarify the legal framework for the reuse of public data in the cultural sector, to analyse the movement towards opening up digital cultural resources in foreign cultural institutions, to formulate perspectives for the evolution of economic models of cultural institutions.
