Exception "Handicap" to copyright and development of the offer of accessible publications in the digital age, Report of the General Inspection of Cultural Affairs (IGAC), May 2013.

The aim of the legislator, in creating the disability exception to copyright, was “to offer persons with disabilities a reading as close as possible to that offered to the general public.” It is clear that this objective is far from being achieved to date: the annual production of adapted publications representing only 3.5% of the «consumer» offer, and the overall offer, less than one fifth of the references available in France. More seriously, if nothing is done, this gap will inevitably widen. The first element of the diagnosis: the production of adapted publications benefits only at the margin of technologies from the internet. The second diagnostic element is that adaptive publishing is still lagging behind library mutations in the digital age. Third diagnostic element: the definition of the scope of the beneficiaries does not make it possible to meet the proven needs, especially in the field of education.

The particular question of the development of audio-description is also linked to one of the projects being undertaken at inter ministerial level, namely the identification and recognition of the professions of disability and universal design. For both cinema and television, the Ministry of Culture and Communication found it necessary to make progress in identifying and recognising occupations related to audio-description. A mission was therefore carried out, in order to clarify the legal status (framework and rights) of the people who carry out these adaptations.
