1% artistic

The 1% artistic is a measure that consists in reserving 1% of the amount before tax of any public construction for the realization of a work integrated in the architecture.

The Decree no. 2005-90 of 4 February 2005 amending the decree of 29 April 2002, redefines and clarifies the conditions for the award of contracts and sets two procedures according to the amount of the "1%", either lower or higher than 30,000 euros before tax, a procedure that necessarily involves the Drac.

Two procedures

Where the calculated amount is less than 30,000 euros before tax, the person responsible for the contract may, after consulting the supervisor, the user of the work and the regional director of cultural affairs, order or purchase one or more works of art from one or more living artists. In the case of an order, the provisions of the decree shall apply.
When the calculated amount is equal to or greater than 30,000 euros before tax, the person responsible for the contract makes his choice under the conditions provided for by the decree, after consulting the artistic committee and following the procedure mentioned.

Each "1%" operation is monitored by an artistic committee, which is an advisory body to the contracting authority. This committee is responsible for defining the programme of artistic commissions and for giving an opinion on proposals submitted by artists.

Call for applications

In accordance with the principles of the Public Procurement Code, new projects of "1%", except as provided in the decree, are the subject of a call for applications from artists. For the Languedoc-Roussillon-Midi-Pyrénées region, the opinions requested by the contracting authorities may be consulted under Tenders and consultations for all calls under Call for applications of the Ministry website.

To assist operators in drafting their public calls for applications, a indicative frame was developed by the department.

NB The maximum size of each file is 2,000 KB. For the same project, four documents can be posted online.
