Culture and Justice in the Great East
The partnership between the Ministry of Culture and the Ministry of Justice, formalized by a memorandum of understanding, lays down the principle that culture is a right for all persons placed under the control of justice, as well as access to education and health. In the Great East, this policy is carried out by the DRAC with the Inter-regional Directorate of Insertion and Probation and the Inter-regional Directorate of Judicial Protection of Youth.
An interdepartmental policy
The Ministry of Culture and the Ministry of Justice have signed, in 1986 then in 1990, two Memoranda of Understanding which were intended to implement a quality cultural policy for persons placed under justice. Culture is indeed a factor in the construction, even reconstruction of the person and a major element in a path of re-integration.
In 2009, a third protocol takes into account all the public in the open environment, minors under the protection of the youth, the families of persons placed under the control of the courts and the training of the staff of the two administrations.
One circular implementing this third protocol, signed on May 3, 2012, covers, thematic by thematic, in a concrete way, the different orientations to be implemented in a way. It is accompanied by 7 fact sheets (available in pdf format at the bottom of this page).
On March 14, 2022, a fourth protocol is signed. It is the result of working groups composed of professionals from the world of culture, the Ministry of Justice and the Ministry of Culture that have brought out several axes of evolution for culture in detention. The text takes into account the emergence of new issues, for example digital, media and image education and reminds that all audiences are concerned by the cultural policy of the Ministry of Justice, major and minor, follow-up in both closed and open environments.
The Universal Declaration of Human Rights of 10 December 1948 Article 27 states that “ Everyone has the right to participate freely in the cultural life of the community, to enjoy the arts and to participate in scientific progress and the benefits that result from it. ».
Article D 440 of the Code of Criminal Procedure states that access to culture for persons under the control of the courts is a right on the same basis as education or health.
France’s 2005 ratification of the Unesco Convention on Cultural Diversity, a particularly significant diversity among persons placed under the control of justice, further reinforces the sense of this partnership policy.
A quality cultural action
The National Memorandum of Understanding sets out the principles for quality cultural action in the prison environment, while ensuring the reintegration of detained persons and enhancing the role of prison staff.
A regional variation
In the Great East, this policy is carried out by the DRAC with the Inter-regional Directorate for Insertion and Probation (DISP) and the Inter-regional Directorate for the Judicial Protection of Youth (DIR-PJJ) within the framework of a regional convention anda regional and annual “Culture Justice” call for projects.
The call for projects "Culture and Justice"
The objective is to encourage prisons and those under the jurisdiction of the PJJ to co-build an artistic and cultural project with cultural professionals (cultural structure, artistic team of all artistic fields) directly related to the needs of persons in custody.
Co-construction between the partners takes place throughout the year, the files must be submitted by 30 November of the year preceding the action in order to be the subject of an inter-ministerial commission. Successful projects are co-funded by DRAC and DISP or DIRPJJ.
