Protection under historic monuments
In France, a historic monument is a building or a movable object receiving a special legal status intended to protect it, because of its historical, artistic, architectural, but also technical or scientific interest.
The legislation distinguishes between two types of buildings, classified and registered:
- are classified among the historical monuments, in whole or in part, ' buildings whose preservation is of public interest from the point of view of history or art This is the highest level of protection, and concerns the exterior, interior and its surroundings.
- are inscribed among the historical monuments, in whole or in part, ' buildings which, without justifying a request for immediate classification as historic monuments, are of sufficient historical or art interest to render their preservation desirable ».
The application for protection is made up of those responsible for the protection of the regional conservation of historic monuments (CRMH), possibly by the regional archaeological service (SRA).
It is submitted to the Regional Heritage and Architecture Commission (RCAP) and its permanent delegation for their opinion.
In the event of a favourable decision, an order is made. In the case of an inscription, the decree is prepared by the services of the DRAC and submitted to the signature of the regional prefect; in the case of a classification, the decree is taken by the Minister of Culture after opinion of the National Commission of Heritage and Architecture (CNPA).
The owner and the mayor of the municipality are informed of the current protection procedure. However, the enrolment decision may be made without their consent.
Conversely, the classification must obtain the formal agreement of the owner or owners. In the event of refusal, the Minister of Culture may initiate the procedure for automatic filing. In this case, after the opinion of the CNPA, the classification may be pronounced by decree in the Council of State.
