Tax credit scheme for quality artistic events organised by casinos
The device was renewed in 2016 (Decree no. 2016-838 of 24 June 2016 and the Decree of 5 September 2016, adopted for the application of Article L. 2333-55-3 of the General Code of Local Authorities on Quality Artistic Events Organised by Casinos, entitled to a tax credit.
As a reminder, in 1947 an incentive tax measure was introduced enabling casinos to reduce the base of the progressive levy on the proceeds of gambling to the extent of the commercial deficit incurred in organizing an artistic event so that these-They develop a "demanding" cultural and artistic offer. In this context, the State and the municipalities reimburse over €12 million/year to casinos.
The new mechanism replaces Decree No. 97-663 of 29 May 1997 adopted pursuant to Article 34 of the 1995 Finance Act in order to comply with French and European regulations. The scope of the old system has not changed. The reform is based on three principles:
- be budgetary neutral for all the actors concerned;
- ensure the sustainability of the scheme by securing it legally, in particular by defining the concept of "quality artistic event" and clarifying the list of eligible expenses;
- simplify its management and control in order to reduce administrative constraints and reduce repayment periods.
The reform introduces a refundable tax credit system that replaces the abatement scheme. In order to ensure equal treatment between casinos, the text makes a change in the nature of the abatement (a scheme based on a reduction of base which de facto favours large casinos) and replaces it with a refundable tax credit system (reduction in the amount of levies) allowing the aid to be modulated according to the financial effort devoted by the casino to the organisation of the MAQ rather than according to its gaming product.
