The Minister of Culture and Communication, Fleur Pellerin, welcomes today’s ruling by the Council of State, which rejects the requests for annulment directed against the decision no. 15 taken by the commission for the remuneration of private copying on 14 December 2012.

 

The Minister reaffirms her commitment to the private copying mechanism, which, in return for the exception open to users to make copies of works for private use, to offer fair compensation to creators through a levy on the sale price of materials used for copying. Private copying is both a freedom for users and an important resource for rights holders, amounting to around 200 million euros, a quarter of which goes to actions of general interest such as artistic creation projects, music, theatre, dance, etc. festivals and training for artists.

 

The minister sees in the decision of the Council of State a recognition of the efforts made by the private copying commission, which drew the consequences of previous decisions of the Council of State and the intervention of the legislator by the law of 20 December 2011. The remuneration for private copying is now consolidated, with methods of calculation clarified, validated by the decision by the Council of State, and new scales valid without limitation of duration.

 

Wishing to take advantage of this impulse, Fleur Pellerin calls on all stakeholders mobilized on these topics, The European Parliament, the Council and the European Parliament have been working together to ensure that the European Parliament, the Council, the Commission and the Member States of the European Union are able to play a constructive role in this process. It will work in this direction with the chair of the commission, Mr. Hadas-Lebel, and all its members, in conjunction with the other ministers concerned. In any event, it will ensure the future of this essential system and its constant adaptation to economic and technological developments.
