5. Definitions
“The website” means the website “Culture.gouv.fr”.
“Partners” means public institutions under supervision, local and regional authorities and any third-party contributors.
II - General conditions of use
The portal «Culture.gouv.fr» is the public legal offer of the Ministry of Culture.
It includes all the information relating to the cultural policies defined by the Minister of Culture, the current events and the agenda of the Minister, the operations and the actions carried out by the Ministry of Culture and its partners. It makes the wealth of digitized cultural heritage accessible to as many people as possible throughout the territory. It is the single point of access to cultural data and content that the Ministry of Culture, its public institutions under supervision and its partners produce and/or hold.
Anyone who accesses the website, to any of the editorial offers or associated services accepts and undertakes to respect, without restriction or reservation, the present general conditions of use in force.
1. Purpose
The purpose of these General Conditions of Use is to define the terms of access and reuse of content and data on the website.
2. Warning
The applicable General Conditions of Use are those whose current version is available online on the portal at http://www.culture.gouv.fr/Mentions-legales and on the date of the user’s login.
The Ministry of Culture is currently auditing the legal notices of its publications and reserves the right to make substantial changes or not, at any time and without notice, to these Terms of Use, to bring them in line with the recommendations of the report on the openness and sharing of public cultural data published in January 2014. Therefore, it is recommended that users regularly refer to these General Conditions of Use to stay informed of any changes. All files allowing free reuse of cultural public content and data of the Ministry of Culture will eventually be downloadable in a dedicated space on the website as well as on the government platform data.gouv.fr.
3. Access to administrative documents and reuse of public information
Under the provisions of Article 24 of Law No. 78-753 of 17 July 1978 on various measures to improve relations between the administration and the public and various administrative, social and fiscal provisions and Article 42 of Decree No. 2005-1755 of 30 December 2005 on freedom of access to administrative documents and the reuse of public information.
4. Intellectual Property and Reuse
4.1 General structure of the website
The general structure of the website is the exclusive property of the Ministry of Culture. It is made available under the terms of licence CC-BY-SA 3.0 EN
4.2 Marks
The trademarks of the Ministry of Culture and its partners as well as the logos appearing on the site are trademarks registered and registered with the INPI and are, as such, protected by an industrial property right.
Any total or partial reproduction of these trademarks or logos made from the elements of the site without the express permission of the administration is therefore strictly prohibited and constitutes an infringement offence within the meaning of the intellectual property code.

4.3.1 Cultural content and data produced by the Ministry of Culture
a) Text
The texts available on the website are scientific, cultural and educational content prepared by the Ministry of Culture. They are made available under the terms of license CC-BY-SA 3.0 EN
b) Images / Hyperimages
Images and hyperimages include photographs, screenshots and illustrations.
Subject to the intellectual property rights of third parties, images and hyperimages which are the exclusive property of the Ministry of Culture are made available under the terms of the license CC-BY-SA 3.0 EN
Images that have entered the public domain are indicated as such by affixing the public domain mark.
For hyperlinked images, refer to section 4.4.
c) Multimedia
The contents of the Documentation section are the exclusive property of the Ministry of Culture.
As such, any reproduction, any total or partial representation, any use, any adaptation, any provision or modification of these data and contents, by any process whatsoever, by any person whatsoever and by any means whatsoever, without the express permission of the Ministry of Culture, potential authors or their rights holders, is strictly prohibited and constitutes an infringement offence within the meaning of the intellectual property code.
Only use for strictly personal or educational purposes is permitted, subject to prior express permission from the Ministry of Culture.
d) Metadata
Metadata includes records, short records and thesaurus available on the website. They are made available under the terms of the open licence.
e) Other public data (statistics, economics, etc.)
Public data held or produced by the Ministry of Culture not referred to in the preceding articles are made available by default according to the terms of the open licence.

Users wishing to reuse the content and data thus made available must indicate:
the title associated with the content or data;

4.3.2 Cultural content and data produced by Ministry of Culture partners and listed on the website
The partners' terms and conditions of use apply to all content and cultural data that they produce or hold and that are accessible on the departmental Internet sites.
4.4 Hyperlinks
The Ministry’s Websites may provide deep hyperlinks to third-party websites and references to other websites. These links or references do not constitute approval or validation of their contents. The Publisher of the Websites of the Ministry may in no case be held responsible for the content of such sites, and shall not be held responsible for any damage or injury arising therefrom. The fact of offering deep hyperlinks to other sites provided to users solely for convenience does not therefore create any obligation of any kind at the expense of the Editor of the Websites of the Ministry which has no means of control and monitoring of the referenced site as well as its evolutions and updates.
The creation of hypertext links to the Websites of the Ministry is free provided that it does not prejudice the material or moral interests of the Ministry of Culture and does not create confusion about the source of the services and/or content.
